Closed consultation on draft regulations on overseas transfer of personal information

On 14 August 2023, the Korean Personal Information Protection Committee (PIPC) closed its consultation on the draft regulations on overseas transfer of personal information . The regulations aim to establish a procedure for certification for the overseas transfer of personal information and suspension orders of transfers as required by the Personal Information Protection Act. The draft regulations create an overseas transfer expert committee which will, at the request of the data protection authority (PIPC) review the level of personal information protection ensured by a certification for the overseas transfer of personal information and will submit its report to the PIPC. The committee will also review and inform the PIPC on the level of personal information protection in a target country where the overseas transfer is to take place. Finally, the expert committee will review and inform the PIPC on potential orders to suspend the overseas transfer of personal information. The PIPC will have the power to decide on certification, recognition of target countries and suspension orders.
