Implemented Order 60-E/2016 approving standard contractual clauses for data transfers and list of countries providing adequate levels of data protections

On 18 November 2016, order 60-E/2016 was implemented following its publication in the National Bulletin. The order approved the use of Standard Contractual Clauses (SCCs) for transferring data to jurisdictions that do not have an adequate level of data protection. The SCCs will have to be incorporated into the international transfer agreements. Furthermore, the order adopted the list of countries that provide an adequate level of data protection. The list includes European Union Member states, Members of the European Economic Area (EEA), the Swiss Confederation, Guernsey, Jersey, Isle of Man, Faeroe Islands, and Canada only with respect to its private sector, and Andorra, New Zealand, Uruguay and Israel only with respect to data that receives automated processing.
