Introduced Terms-of-service Labeling, Design and Readability Act of 2023 (TLDR Act/HR 4568) including quality of service requirements

On 11 July 2023, the Terms-of-service Labeling, Design and Readability Act of 2023 (TLDR Act/HR 4568), including quality of service requirements, was introduced in the United States House of Representatives. The Act reintroduced the requirements outlined in Bill S 3501 and HR 6407, which failed to pass before the 117th Congress adjourned. The TLDR Act applies to persons or entities operating a website for commercial purposes and exempts small businesses, as defined in the Small Business Act. The Act would require entities to integrate a succinct summary table at the forefront of the terms of service to enable consumers to have a better understanding of conditions of use and service termination. Furthermore, the entities would have to specify the data they collect, including sensitive data, and provide information regarding data that is shared with third parties. Additionally, the Act stipulates the utilisation of XML tags to annotate the comprehensive long-form terms, to enhance accessibility and comprehensibility of the agreements for both consumers and researchers.
