Adopted Administrative Measures for Generative Artificial Intelligence Services including data protection regulation

On 10 July 2023, the Chinese Cyberspace Administration of China (CAC) adopted the Interim Measures for the Management of Generative Artificial Intelligence Services to regulate the use of generative artificial intelligence (AI) within China. The Measures apply to the use of generative AI technology to provide services for the generation of text, pictures, audio, and video content to the public within Chinese territory. AI service providers are responsible for the legitimacy of the data used to train generative AI products and are required to obtain the subject’s consent if the data contains personal information. AI service providers have the obligation to protect personal information and are required to accept and process a data subject’s request to access, review, correct or delete their personal information. Providers are prohibited from collecting non-essential personal information. The Measures will take effect on 15 August 2023.
