Germany: Closed investigation into Lieferando concerning price parity clause

On 12 July 2023, the German Competition Authority (Bundeskartellamt) closed its investigation into Lieferando, a platform providing online food ordering services. The investigation was initiated due to concerns over the platform’s price parity clause which prohibited restaurants from offering their products for a lower price on other distribution channels. The investigation into Lieferando was closed after the Bundeskartellamt determined it did not have sufficient indications to suggest that the parity clause represents a serious barrier to market entry by new platforms offering differentiated services.
