On 13 June 2023, the Securing Children Online through Parental Empowerment Act (SCOPE Act/ HB 18), including data protection regulation, was signed into law by the Governor of Texas. The Act would require digital service providers to enable parents, at the point of account creation for a minor, to permanently enable certain privacy settings and prevent the collection of certain types of information. Further, digital service providers would be required to give parents certain user rights in regard to minors' information, including access. Finally, digital service providers would be required to collect minors' data only for the purpose of providing the service and would be prohibited from sharing, disclosing or selling the minor's data and collecting geolocation data. The Act enters into force on 1 September 2024.
