Implemented Revised Advertising Law

On 26 October 2018, the Standing Committee of the National People's Congress announced and implemented a revision of the Advertising Law. The Advertising Law sets out general requirements regarding the content and display of advertising. Its provisions also apply to internet advertising. The Law further obligates internet information service providers to prevent the publication or sharing of illegal advertisements on their platforms. Finally, the Law provides that online advertisements should not interfere with normal use of the internet. For example, pop-up advertisements should have a clear sign indicating where they can be closed and should be closable with a single click. The revised version of the Law primarily shifts enforcement responsibilities from administrative departments for commerce and industry to market supervision authorities.
