Adopted Office of Privacy Commissioner Guidelines on the use of generative Artificial Intelligence

On 25 May 2023, the Office of the Privacy Commissioner (OPC) issued Guidelines on the use of generative Artificial Intelligence (AI) tools and compliance with privacy regulations. The OPC noted that AI tools powered by large amounts of data could pose risks concerning the confidentiality and accuracy of the information and the handling of personal data. The OPC notes that agencies wishing to use AI tools, including those in the public and private sectors, need approval from senior leadership, assess if the AI tool's use is necessary and proportional and conduct a privacy impact assessment. The Guidelines also recommend establishing procedures for ensuring data accuracy and accessibility. Additionally, businesses should ensure that the AI tool does not retain or disclose sensitive data.
