Adopted ANPD statement on the processing of personal data of children and adolescents under LGPD

On 24 May 2023, the National Data Protection Authority (ANPD) published a statement on the processing of personal data of children and adolescents under the Law for the Protection of Personal Data (LGPD). In particular, the statement specifies that the processing of personal data of children and adolescents is allowed under LGPD if it complies with Article 7, which outlines the circumstances under which the processing of data is allowed, such as consent provided by the data subject, legitimate interest of the controller, compliance with legal obligations or protection of life, and Article 11 regulating the processing of sensitive personal data. Furthermore, the ANPD specified that entities have to ensure that the children's and adolescents' best interests are observed and prevail when processing their personal data.
