On 20 April 2021, Law 2020-1266, aiming to regulate the commercial exploitation of the image of children under sixteen on online platforms, including service access restriction, is implemented. The Law came into force 6 months following its publication in the Official Journal. The Law specifies that the distribution of images of a child under 16 years old on a video-sharing platform service is subject to a declaration and approval from the competent authority by the legal representative if it meets the time and profit thresholds specified by a Government Decree. Furthermore, the competent authority will issue recommendations regarding the time, duration and safety of the conditions for making the videos and outline the risk associated with the distribution of the videos. The income obtained from the video distribution exceeding thresholds established by decree will have to be transferred to the Deposits and Consignments Fund until the child reaches maturity if it exceeds the thresholds established through a Government Decree. Finally, the Law requires advertisers engaging in product placement in an audiovisual program broadcast on a video-sharing platform whose main subject is a child under 16 to ensure compliance with the income transfer to the Deposits and Consignments Fund.
