Introduced Bill No. 2338 of 2023 regulating the use of Artificial Intelligence including data protection measures

On 3 May 2023, the Bill No. 2338 of 2023 regulating the use of Artificial Intelligence, outlining data protection measures, was introduced in the Senate of Brazil. In particular, the Bill would require Artificial Intelligence (AI) systems providers to comply with the individuals' right to privacy and personal data protection based on the General Data Protection Law. The will would require providers to inform individuals if they are exposed to emotion recognition systems or biometric categorisation systems and the data used by the system. Furthermore, the will would establish the right of individuals to correct incomplete, inaccurate or outdated data used by the AI systems and request anonymisation, blocking or deletion of data. Finally, the Bill established the right of individuals against discrimination based on personal data, including geographic origin, race, colour or ethnicity, gender, socioeconomic class, sexual orientation, age, disability, religion or political opinions.
