On 9 May 2023, the My Health My Data Act (LD 1902/HP 1217) was introduced in the Maine House of Representatives. The Act aims to establish consumer rights regarding to health data and outlines obligations for entities processing such information. Regulated entities would be required to disclose health data privacy policies and obtain consent for collecting and sharing certain types of consumer health data. Further, the Act would forbid both the sale of consumer health data and the implementation of geofencing around in-person providers of healthcare services. Consumers would be able to take legal action against violating entities and the Act would be enforceable by the State Attorney General.
