Adopted Executive Order 13960 Promoting the Use of Trustworthy Artificial Intelligence in the Federal Government

On 3 December 2020, the Executive Office of the President of the United States adopted Executive Order 13960 Promoting the Use of Trustworthy Artificial Intelligence in the Federal Government, in line with Executive Order 13859 Maintaining American Leadership in Artificial Intelligence. The Order outlines a series of principles for AI, stating that it must be lawful and respectful of US values, purposeful and performance-driven, accurate, reliable, effective, safe, secure, resilient, understandable, responsible, traceable, regularly monitored, transparent, and accountable. The Order also foresees a series of obligations from a later date. Within 180 days of the date of the Order, the Office of Management and Budget (OMB) shall issue common policy guidance for government agencies. Within 60 days, the Federal Chief Information Officers Council (CIO Council) shall identify, provide guidance on, and publish the criteria, format, and mechanisms for agency inventories of non-classified and non-sensitive use cases of AI by agencies. Within 180 days of that, and annually since then, each agency shall prepare an inventory of its non-classified and non-sensitive use cases of AI, excluding AI used for defence purposes or in national security systems, including current and planned uses. Within 120 days of completing their inventories, agencies shall develop plans either to achieve consistency with this order for each AI application or to retire AI applications found to be developed or used in a manner that is not consistent with this order. Agencies shall strive to implement the approved plans within 180 days of plan approval, subject to existing resource levels. Within 60 days of the completion of their respective inventories of use cases of AI, agencies shall share them with other agencies, to the extent practicable and consistent with applicable laws and policies.
