Introduced Georgia Data Privacy Act (HB 798)

On 20 March 2023, the Georgia Data Privacy Act (HB 798) was introduced to the Georgia House of Representatives. The Georgia Data Privacy Act proposes an amendment to Chapter 1 of Title 10 of the Official Code of Georgia Annotated. It aims to prohibit manufacturers of consumer electronic devices from allowing consumers to opt out of certain data collection by third parties unless the consumer can opt out of the same data collection carried out by the manufacturer. Further, the Bill provides definitions for terms and outlines the Act's enforcement, limitations, exclusions, construction and applicability. The Act, if adopted, will apply to consumer electronic devices sold or in use on or after 1 July 2023.
