On 13 May 2020, the Brazilian Law on Freedom, Responsibility and Transparency on the Internet (Bill 2630/20) including data protection regulations was introduced in the Senate. The Bill includes data protection standards, rules for data access for research purposes, the obligation to make data publicly available and consent-based data processing requirements. The Bill would require application providers to publish data on the number of accounts and content flagged, deleted or suspended, the reason for such actions and the data regarding the number and activity of artificial disseminators. Furthermore, the providers would be required to report on the number of users in Brazil and the content classified as misinformation to provide the number of views, shares and other relevant metrics. The Bill would require providers to comply with personal data protection regulations and share data with research institutions for disinformation analysis. Finally, the application providers would be required to obtain consent from users to collect and process their data and receive mass messages or be included in a group.
