Indonesia: Announced case on constitutionality of Art.15(1)(a) of Personal Data Protection Law (Case No. 110/PUU-XX/2022)

On 7 November 2022, Case No. 110/PUU-XX/2022 was submitted to the Constitutional Court of Indonesia requesting judicial review of Article 15(1)(a) of the Personal Data Protection Law. The plaintiff requested a judicial review of the Article, which allows the limitation of data subject rights in relation to national security and defence matters, arguing that there was a lack of legal certainty regarding the circumstances in which such a limitation was legitimate.
