Adopted Enforcement Decree for the amended Telecommunications Business Act (Decree No. 31223)

On 8 December 2020, the Enforcement Decree of the amended Telecommunications Business Act (Decree No. 31223) was adopted. The Decree implements Law No. 18869, amending the Telecommunications Business Act and outlines the thresholds that would make the information and communications network providers (CNP) and value-added telecommunications service providers (VSP) subject to the quality of service requirements. The Decree specifies that the requirements apply to CNP and VSP, which account for more than 1% of Korean internet traffic and have an average daily user base of 1 million over a period of three months. The VSP and CNP that reach the thresholds have to implement measures to ensure "secure means for stability of service" and "process user demands". Furthermore, the foreign CNP and VSP that meet the thresholds are required to appoint a local representative.
