On 10 November 2022, the Draft Bill Regulating Digital Platforms (PL 2768/2022) was introduced in the Brazilian House of Representatives (Chamber of Deputies). Under the Draft Bill, large digital platforms with annual revenue of at least BRL 70 million would be considered "essential access control power holders". As a consequence of this qualification, these platforms would have to fulfil certain transparency and reporting requirements. Furthermore, "essential access control power holders" would be obliged to treat their consumers in a non-discriminatory matter, while having to fulfil certain access requirements for business users. Digital platforms are finally also obliged to pay an inspection fee amounting to 2% of their annual gross operating revenue. Finally, the National Telecommunications Agency (ANATEL) can also sanction platforms with a fine of up to 2% of the national revenue and suspend certain business activities.
