Adopted Decree No. 11.491 enacting the Convention on Cybercrime

On 12 April 2023, Decree No. 11.491 enacting the Convention on Cybercrime (Budapest Convention) was adopted. Brazil adhered to the Convention on 30 November 2022 and entered into force on 1 March 2023. The Convention enables competent authorities in a ratifying state to request the information needed to identify the owner of domain names registered in the territory of another party state for the purposes of a criminal investigation. Further, the competent authorities of a ratifying state can directly request subscriber information from service providers in another party state through the legal basis of the requesting state. The Decree enters into force on the day of its publishing in the Official Gazette.
