On 13 April 2023, the Ordinance No. 351/2023, establishing administrative measures for preventing the dissemination of harmful content by social media platforms, entered into force following its publication in the Official Diary of the Union. The Ordinance empowers the National Secretariat for Public Security (Senasp) to coordinate the submission by social media platforms of data that allows the identification of a user disseminating content promoting violence in schools. Senasp will also be in charge of creating a database of illegal content and of providing guidance to platforms on preventing the creation of new profiles from Internet protocol addresses (IP addresses) in which illegal, harmful and dangerous activities have been detected related to content that encourages or incites attacks on schools. Furthermore, the Ordinance specifies that social media platforms would be required to remove content that was determined as harmful by authorities. Finally, the Ordinance gives the National Consumer Secretariat (Senacon) the power to initiate administrative proceedings against social media platforms that fail to comply with the content moderation requirements and implement measures limiting the spread of harmful content.
