Adopted EDPB binding decision on cross-border data transfers from the EU to the US by Meta (Facebook)

On 13 April 2023, the European Data Protection Board (EDPB) announced that it adopted a binding dispute resolution decision under Article 65 of the EU General Data Protection Regulation (GDPR) concerning a draft decision of the Irish Data Protection Authority (DPA) on data transfers to the United States by Meta Platforms Ireland Limited. The EDPB decision settles a dispute between several DPAs on whether an administrative fine and an additional order to bring processing into compliance must be included in the Irish DPA's final decision. The EDPB decision ensures the consistent application of the GDPR by national DPAs. The Irish DPA must adopt its final decision, taking into account the EDPB's legal assessment, within one month of the EDPB notifying its decision.
