Announced possible suspension of order blocking OpenAI ChatGPT

On 12 April 2023, the Italian Data Protection Authority (DPA) announced it would suspend its order blocking OpenAI’s platform ChatGPT if the company complies with the requirements imposed by the DPA by 30 April 2023. In particular, the DPA has required the company to adopt measures regarding the protection of personal data and to provide on its website specific information on the use and processing of personal data, as well as the rights of users and interested parties. In addition, OpenAI will be required to implement an age verification system for minors and to submit an action plan that excludes access to users under thirteen and minors without parental or guardian consent. The platform will also have to provide users and interested parties with tools to request the rectification or deletion of personal data. Finally, OpenAI will have to carry out an information campaign online, on radio, television and in newspapers to inform the public about the use of personal data for the purpose of algorithm training.
