On 9 March 2023, Senate Bill SB396 creating the Social Media Safety Act was introduced in the State of Arkansas Senate. It would require age verification and parental consent for social media use of minors. The Act also clarifies the liability of platforms for failures in age verification and illegal retention of data. The Act defines “social media platforms” to exclude direct messaging applications with messages that are not posted publicly, as well as any social media platform controlled by an entity that has generated less than USD 100’000’000 in annual gross revenue. If passed, the Act will come into effect on 1 September 2023.
