On 4 April 2023, the Federal Data Protection and Information Commissioner issued a guideline on the use of ChatGPT and comparable AI-supported applications, outlining the data protection requirements providers of AI applications are required to follow. The FDPIC stated that AI application providers must comply with the data protection regulations, including informing users in a "transparent and understandable manner "of the purpose of personal data collection and processing. Finally, the FDPIC noted that it is collaborating with the Italian Data Protection Authority (Garante) to obtain additional information following its order banning OpenAI from processing the personal data of Italian users through its platform, ChatGPT.
