Signed Senate Bill 1087 on Genetic Data Privacy

On 26 March 2023, Bill 1087 to amend the Code of Virginia by adding provisions relating to genetic data privacy, was signed into law by the Governor. The Bill establishes requirements for direct-to-consumer genetic testing companies, including requirements related to the information to be provided to consumers, express consent requirements, requirements related to the security of and consumer access to genetic data, and prohibitions on disclosure of genetic data, among others. The Bill also prohibits discrimination against a consumer based on the exercise of rights related to genetic data privacy. The Bill comes into force on 1 July 2023.
