On 30 November 2023, the Court of Appeal issued a verdict supporting the Competition and Markets Authority's (CMA) choice to initiate an investigation into mobile browsers and cloud gaming. This decision reversed a prior ruling that had annulled the investigation. Consequently, it overruled the Competition Appeal Tribunal's (CAT) earlier decision in March 2023, which had favoured Apple in an appeal and temporarily stopped the Competition and Markets Authority's (CMA) investigation until the Court of Appeal delivered its judgment. However, the CMA's market investigation remains on hold, awaiting the resolution of any application seeking permission to appeal to the Supreme Court.
