Opened Consultation on the Digital Competition Act

On 12 March 2024, the Indian Ministry of Corporate Affairs opened a consultation on the Digital Competition Act until 15 April 2024. The Act, recommended by the Committee on Digital Competition Law, proposes an ex-ante regulatory framework specifically for large digital enterprises. It aims to proactively monitor the behaviours of these enterprises and intervene before instances of anti-competitive conduct occur. The Act also proposes the designation of certain enterprises as “systemically significant digital enterprises” (SSDEs) and outlines obligations, exemptions, enforcement procedures, and penalties for non-compliance.
