Closed Consultation on the Digital Competition Act

On 15 April 2024, the Indian Ministry of Corporate Affairs closed its consultation on the Digital Competition Act. The Act, recommended by the Committee on Digital Competition Law, introduces an ex-ante regulatory framework specifically for large digital enterprises. It aims to proactively monitor the behaviours of these enterprises and intervene before instances of anti-competitive conduct occur. The Act also proposes the designation of certain enterprises as “systemically significant digital enterprises” (SSDEs) and outlines obligations, exemptions, enforcement procedures, and penalties for non-compliance.
