Issued ruling in FCA investigation into Google’s use of market power to allegedly circumvent the right of content renumeration for press agencies and publishers (Decision 21-D-17)

On 13 July 2021, the French competition authority (FCA; Autorité de la Concurrence) fined Google with a pecuniary sanction of EUR 500 million. In case of non-compliance with the injunctions issued on 9 April 2020 and upheld by the court on 8 October 2020, the company will face additional penalties of EUR 300'000 per day. In the following two months, Google will have to negotiate with news agencies and publishers regarding the remuneration of the content Google displays (injunction 1) and be transparent about the basis of the remuneration (injunction 2). Google can appeal the penalty ruling.
