Issued Guidelines for obtaining consent from data subjects under the PDPA

On 7 September 2022, the Ministry of Digital Economy and Society of Thailand published the “Guidelines for obtaining consent from data subjects under the Personal Data Protection Act (PDPA)” issued by the Personal Data Protection Commission of Thailand. The Guidelines lay out in detail the cases where the PDPA requires the data controller to notify the data subject on the collection, use, or disclosure of their personal data. In addition, the Guidelines outline the criteria for requesting consent and the requirements for consent to be considered valid, including consent from minors. The Guidelines require for consent to be explicit.
