Republic of Korea: Announced Amendment to Enforcement Decree of the Information and Communications Network Act

On 24 April 2024, the Korea Communications Commission announced the preparation of an amendment to the Enforcement Decree of the Information and Communications Network Act. This amendment aims to address the 'blind spots' in blocking access to illegal sites by clarifying the scope of information and communications service providers that install and operate servers for temporary storage of data in the country and the necessary measures to prevent the distribution of illegal information. Specifically, the amendment targets Content Delivery Network (CDN) operators with information and communications service sector sales of over KRW 1 billion, who will be required to take technical and managerial measures to prevent the distribution of illegal information. The Korea Communications Commission plans to gather opinions through a legislative notice and consultation, with the amendment expected to be proclaimed and implemented in July 2024.
