Issued Federal Supreme Court ruling ordering investigation into X platform and its owner regarding compliance with judicial oversight

On 7 April 2024, the Federal Supreme Court (STF) issued a ruling ordering Elon Musk, the owner of the social network X (formerly Twitter), to be included in the Federal Police investigation into digital militias (INQ 4874). The STF also initiated an investigation into Musk's actions regarding obstruction of justice, criminal organisation, and incitement to crime. Additionally, the STF mandated that if the social network X violates any court order by reactivating profiles blocked by either the STF or the Superior Electoral Court (TSE), the company will face a daily fine of BRL 100'000 per profile. The STF noted that its decision follows Law 12.965/14, which provides for judicial oversight of Internet activities and mandates compliance with court orders by Internet service providers.
