Italy: Closed Public Consultation on Communication on Application of Article 1, Paragraph 5, Decree-Law 10 August 2023, No. 104

On 4 April 2024, the Italian Competition Authority closed the public consultation on its Communication on the application of Article 1, Paragraph 5, Decree-Law 10 August 2023, No. 104, as converted by Law 9 October 2023, No. 136. The consultation was opened on 5 March 2024. The Communication aimed to define the scope and procedures of the application of the aforementioned article, which sets out the applicable procedure for the imposition of structural measures following the finding of market distortions in a fact-finding investigation into a company’s economic activities. Interested parties were invited to submit their observations within 30 days of the publication of this decision.
