In June 2020, the Jamaican Government enacted the Data Protection Act, 2020, which incorporates a requirement for business registration. Before engaging in the processing of personal data, all data controllers are obligated to submit a prescribed fee and register specific 'registration particulars' with the Commissioner. Additionally, the controller must furnish a general description of the measures intended to comply with the standard of implementing appropriate technical and organizational measures. In cases where data is processed or is intended to be processed based on an order of the Minister of Science, Energy and Technology outlining activities unlikely to compromise the rights and freedoms of data subjects, a corresponding statement must be provided.
