In June 2020, the Jamaican Government adopted the Data Protection Act, 2020, which encompasses provisions for data protection. Notably, the Act establishes that consent serves as a legal foundation for the processing of personal data, especially in cases involving direct marketing or the transfer of data to third parties. All data controllers must adhere to the eight data protection standards outlined in the Act. These standards include, among others, principles such as fairness, lawfulness, purpose limitation, data minimisation, and accuracy.
