Adopted Advanced Computing Chips Rule 2023 (AC/S IFR)

On 17 October 2023, the US Bureau of Industry and Security (BIS) adopted the Advanced Computing Chips Rule of 2023 (AC/S IFR). The BIS amended the parameters for identifying restricted chips and limited the export of chips based on the compatibility of certain parameters. The BIS also introduced a notification requirement for the export of certain additional chips with performance below the previously defined threshold. Furthermore, the BIS established new and extended license and notification requirements and adopted additional due diligence provisions to prevent circumvention with applicable US export controls. The Rule enters into force on 16 November 2023. The public consultation on the adopted Rule will open for 60 days following its publication in the Federal Register.
