Adopted BIS Rule updating authorisation for exports to Samsung and SK hyinx semiconductor facilities in China

On 13 October 2023, the US Commerce Department's Bureau of Industry and Security (BIS) issued a rule updating the authorisations for Samsung and SK hynix on the import of US goods for their semiconductor production facilities in China. Both companies applied for the authorisation as Validated End-Users (VEUs) which allows them to obtain a general authorisation from the US government instead of applying for multiple individual licenses. The authorisation was issued in the context of the 2022 rule "Implementation of Additional Export Controls: Certain Advanced Computing and Semiconductor Manufacturing Items; Supercomputer and Semiconductor End Use". The rule concerning Samsung and SK hynix will be effective upon publication in the Federal Register.
