Issued ruling against Allegro for using prohibited terms in contracts with consumers

On 29 December 2022, the Polish Office of Competition and Consumer Protection (UOKiK) sanctioned the online shopping platform Allegro with a fine of PLN 4 million for using prohibited clauses in its contracts with consumers. Specifically, Allegro included modification clauses in its contracts with consumers setting up an account on the platform. By setting up an account, users are entitled to free delivery of their purchased goods. Allegro, however, stipulated in its contracts that conditions can be changed in case of "technological and functional changes or economic and market conditions". Without defining the scope or conditions that must be met for contracts to be changed, Allegro would be violating the law.
