Appeals court ruling reducing fine on Apple, Tech Data and Ingram Micro for anti-competitive agreements

On 6 October 2022, the Court of Appeal of Paris reduced fines imposed by France's Competition Authority (FCA) on Apple and its two wholesalers in France. For Apple, the fine was reduced from EUR 1.1 billion to EUR 371.6 million after dropping one of the main charges related to price-fixing allegations and lowering the rate of calculation of the fine. For Ingram Micro the fine was reduced from EUR 62.9 million to EUR 19.5 million and for Tech Data from EUR 76.1 million to EUR 24.9 million. On 15 March 2020, the FCA fined Apple for anti-competitive behaviour in its distribution and retail network after finding that Apple imposed prices on authorised resellers to align prices with those charged by Apple in their own stores and on their official website. Apple's two wholesalers in France, Tech Data and Ingram Micro had also been fined for their roles in the anti-competitive agreements.
