MICT closes public consultation on draft Data Protection Bill including cybersecurity regulation

On 30 November 2022, the Namibian Ministry of Information and Communication Technology (MICT) closed its public consultation on the draft Data Protection Bill including cybersecurity regulation. The Bill would oblige data controllers to take appropriate and reasonable measures to prevent the loss of or unauthorised access to personal data in its possession, including continual risk assessment and the implementation of safeguards. Furthermore, the Bill would require data controllers to ensure that third parties processing personal data adhere to certain security and confidentiality standards. Finally, the Bill sets out data controllers' duty to notify the Data Protection Supervisory Authority and the affected data subjects in case of a data breach.
