On 17 October 2022, the California Privacy Protection Agency (CPPA) published a modified proposal for a revised version of the California Privacy Rights Act Regulations (CPRA Regulations). The proposed changes were introduced in response to comments received during the public consultation period that closed on 23 August 2022. The modified proposal notably states that businesses do not need to give notice of the right to limit sensitive personal information use if the business does not collect the information for consumer profiling. Further, it specifies that the purpose of collection or processing must be consistent with the consumer’s “reasonable expectations”. The modified proposal also sets requirements for third parties collecting personal information to provide a collection notice. Further, it regulates the concept of “disproportionate efforts” limiting the obligation to respond to user right requests in cases of disproportionate effort. The revised version of the CPRA Regulations will be reviewed in the CPPA Board meeting scheduled for 28-29 October 2022.
