On 28 March 2022, the Dutch Authority for Consumers and Markets (ACM) imposed a fine of EUR 5 million for the tenth time, in response to Apple's forthgoing non-compliance with requirements on dating-app providers and thereby reaching the maximum fine under the current ruling. In addition, the ACM noted that Apple submitted a new payment policy proposal on 27 March 2022, which the ACM welcomes and will submit to market participants for consultation before assessing its compliance with the ACM's requirements. The ACM had previously ruled that Apple failed to meet the ACM's requirements regarding the payment system for dating-app providers, resulting in a periodic penalty of EUR 5 million every week, up to a maximum of EUR 50 million. In order to comply, Apple needs to change the terms of admission to the Dutch App Store for dating-app developers, to permit them to use payment methods other than Apple's payment mechanism in the App Store. Furthermore, dating-app providers must be able to relate to payment systems that are not part of the app.
