On 29 December 2021, China's State Administration for Market Regulation (SAMR) has closed the consultation on the Measures on the Administration of Online Advertising (Draft for Public Comments), containing proposed regulations for the internet advertising industry. The Draft Measures stipulate that prohibited products, prescription drugs and tobacco may not be advertised on the internet. Certain products, such as medicine, beauty, and online games, may not be advertised on websites aimed at minors. Further, certain services and commodities, including many medical services and products, must be subject to review before they can be advertised. The Draft Measures would also require advertisements to be identifiable as such, and users would need to be able to close advertisements easily. Advertisers would also be responsible for the legality and authenticity of adverts, and advertising operators would be responsible for setting up filing systems with information of the advertisers they work with. The Draft Measures also set out enforcement procedures, such as investigatory powers, and the power to issue injunctions and fines.
