Booking.com appeals decision and order of the FAS Russia to refrain from applying price parity obligations in contracts

On 4 February 2021, Booking.com BV filed a lawsuit before the Moscow Arbitration Court in an effort to appeal the ruling by the Russian Federal Antimonopoly Service (FAS) on 1 December 2020. The ruling alleged that booking.com had violated antitrust rules, specifically, clause 3 of part 1 of article 10 of the Law on the Protection of Competition. The company claimed that the FAS ruling was illegal and in violation of their rights and legitimate interests in the entrepreneurial field and other economic activities. Furthermore, Booking.com BV argued that the FAS' order to exclude the best price clause was illegal.
